Henry Nutton AYERS was said by his daughter-in-law to be an only child,from a "good Suffolk family" 78

In 1845 when he married Martha Ann NUNN, his address was 4 Heneage St (?) in Parish of Christ Church, County of Middlesex. We know that they lived in Hackney, Middlesex when their son, Arthur Robert AYERS, was born on 3 Aug 1854. 79

Henry’s death certificate shows that he died of cancer of the liver and stomach at 6 Amherst Rd, West Hackney, on 6 Jan 1868, aged 53. This age makes him the Henry Nutton Ayers born in 1815.

Henry Nutton Ayers left his wife Martha Ann Ayers the sum of £200 to be paid as soon as possible, all household furniture and all other household effects. He left his real estate (if any) and all the residue of his personal estate to his trustees, specifying that they could from time to time pay the income of his trust estate to his wife during her life or until she should marry. After his wife's marriage his trust estate was to be treated as divided into three equal parts. One part was for his wife during her life for her sole and separate use and benefit, without being subject to the debts, control or engagements of her husband. His wife was not to have the power of depriving herself of the benefit part or all of this legacy by any means. After his wife's remarriage, if this should happen, the other two thirds of his trust estate and the income thereof was to be held in trust for such of his children who being sons or a son attain the age of 21, or who being daughters or a daughter attain that age or marry before that age, whichever happens first. If there were more than one such child they would get equal shares. After his wife's death, the remaining part of her third would also be divided among his children. The trustees were authorized to spend up to ¢100 of each child's share on his or her maintenance, education and advancement. But as long as his wife was entitled to the whole or any part of his trust estate, the trustees could not make any advance out of the capital without her written agreement. Will 7 January 1863. 80

In a codicil, dated 30 December 1867, Henry Nutton Ayers, wholesale grocer, changed one of his executors, appointing William Nunn of Coventry in the County of Warwick. The will and codicil were proved at London on 7 March 1868. 80
